Terms of Service

1. The agreement
These Terms of Service (“Terms”) are a contract between you and Scribblebook, Inc.(“Scribblebook”, “we”, “us”). By using scribblebook.com, our APIs, or any of our emailed services (together, the “Service”), you agree to these Terms. If you don't agree, don't upload photos or place orders.
For material changes— anything that expands what we can do with your photos, reduces your refund rights, or changes dispute resolution — we will email the address on file and give you at least 30 days' notice. Continued use after the notice period means you accept the new Terms. Non-material changes (typos, clarifications) take effect on posting.

2. What Scribblebook does
Scribblebook turns photos you upload into AI-generated black-and-white line-art coloring pages, assembles them into a printed coloring book, and ships the book to you. The pipeline uses fal.ai to run our line-art workflow, our own server code to assemble the interior and cover PDFs, Lulu Press to print and ship, Stripe to take payment, Resend to send transactional email, and Supabase to store data. The current sub-processor list lives in the Privacy Policy.
3. Eligibility
You must be at least 18 years old to upload photos, create an account, or place an order. Children may appear as the subject of photos with proper guardian consent (Section 4). Scribblebook is not directed at children. If we learn an account holder is under 18 we will close the account and delete its data per the Privacy Policy.
4. Photos you upload
This is the most important section in these Terms. The Service exists because parents trust us with photos of their kids.
4.1 Rights and permission.You must own or have permission to use every photo you upload. You took the photo yourself, or you have permission from the photographer or rightsholder. We don't check — you're warranting it.
4.2 Guardian consent for any child in the photo. Before you upload, the Service requires you to confirm a checkbox stating: “I'm the parent or legal guardian of every child in these photos, and I have permission for any other people pictured.” That checkbox is a legal attestation. We log the timestamp, the consent-text version, your IP address, your user agent, and the list of sub-processors named at the time. If you are not the legal guardian of a child in the photo, do not upload it.
4.3 Multi-party consent. If other people — adults or children who are not your own — appear in the photo, you confirm you have permission from them (or their guardians). This is your responsibility, not ours.
4.4 The license you grant us. You keep ownership of every photo you upload. You grant Scribblebook a limited, non-exclusive, royalty-free license to use each photo only to:
- (a) run the AI line-art conversion via the fal.ai workflow we configured for this product;
- (b) assemble the interior and cover PDFs;
- (c) transmit the assembled PDFs and shipping metadata to Lulu Press for printing and shipping;
- (d) send you sample previews and order/shipping emails; and
- (e) hold the photo in private storage for the retention windows in the Privacy Policy.
The license ends when the retention period ends. This license does not authorize us to: train any AI or ML model on your photo; run face recognition or face-geometry extraction; sell or share your photo with advertisers, data brokers, or anyone outside the sub-processor list; or use your photo in marketing, social posts, case studies, or sample galleries without separate, written, opt-in consent from you.
4.5 Prohibited content. You may not upload, and we will not knowingly process, any photo that:
- depicts child sexual abuse material (CSAM) or any sexually explicit imagery of a minor;
- depicts an adult in a sexually explicit way;
- depicts graphic violence, gore, or content glorifying self-harm;
- depicts hate symbols or content promoting violence against a protected group;
- contains copyrighted material you do not own or have written permission to use (stock photos, professional portraits without a release, film/TV screenshots, trademarked characters used commercially);
- depicts an identifiable stranger photographed without consent in a private setting; or
- is otherwise illegal in the United States or your jurisdiction.
A single illegal upload — confirmed CSAM in particular — results in immediate account termination, evidence preservation, and reporting to NCMEC and law enforcement where required by law. We cooperate fully with valid legal process. See the Acceptable Use Policy for full enforcement details.
4.6 Discretion to refuse. We may refuse any photo or order if we believe in good faith it violates these Terms or creates legal or reputational risk. Refused orders are refunded per the Refund Policy.
5. Accounts and guest sessions
You can use Scribblebook two ways: as a registered user (signed in via magic link to your email) or as a guest (no sign-up — we hand your browser a signed session cookie that scopes your uploads to you). Both flows use the same upload, sample, and checkout pages.
When you complete payment as a guest, we automatically create an account under the email you used at checkout, so you can sign in later via magic link to view the order and exercise your privacy rights. If an account already exists for that email, we link the order to it. You're responsible for keeping access to your email — we use it as your identity.
6. Pricing, currency, and payment
6.1 Prices. Prices shown on the sample and checkout pages are the final price for that order, in U.S. dollars (USD). The full breakdown — print cost, AI conversion cost, shipping, and our markup — is shown on the homepage and at checkout before you pay.
6.2 Tax.As of the Last updated date, sales tax and VAT are not automatically collected. We may geo-restrict checkout to the United States and Canada at our discretion until automatic tax collection is in place. If your jurisdiction requires you to self-remit tax, that's on you.
6.3 Payment processing.Payments are processed by Stripe. Scribblebook does not store full card numbers. By paying you also accept Stripe's terms and privacy policy.
6.4 Coupons. We may issue promo codes. Each coupon has a maximum number of uses, an expiration date, and may be limited to one redemption per customer. Coupons are not transferable or redeemable for cash. Coupon abuse — fake accounts, code scraping, public sharing of single-use codes, or use of a leaked test code not intended for the public — voids the discount and cancels the order; we refund any actual payment less a reasonable processing fee.
7. Production, printing, and shipping
7.1 Printer.Books are printed by Lulu Press, Inc. on the SKU configured in our product code (8.5″×11″ softcover, B&W interior, 60lb uncoated paper, perfect-bound). We send Lulu the assembled interior and cover PDFs and the shipping address you entered.
7.2 Estimated delivery.5 to 7 business days from the time Lulu receives the print job to delivery within the contiguous United States, using Lulu's “MAIL” shipping level. Alaska, Hawaii, U.S. territories, and international destinations take longer; the actual estimate is shown at checkout. These are estimates, not guarantees.
7.3 Address accuracy.You are responsible for the shipping address you enter. We do best-effort validation only. Undeliverable, returned, or typo'd packages can be re-printed and re-shipped at our at-cost rate (production + shipping, no margin), per the Refund Policy. Address changes are only possible while the order status is paid and before our system has submitted the print job to Lulu.
7.4 International shipping.Where supported, international orders may incur import duties, taxes, and customs fees charged by your country's customs authority. These are separate from the price you paid us and are your responsibility. Packages refused at customs are subject to the at-cost reship pricing in 7.3.
8. Sample previews
Before you pay we generate one watermarked sample page so you can evaluate the line-art quality. The watermark reads “SCRIBBLEBOOK PREVIEW” and is not present on the printed book. Sample preview links are private and expire 30 days after your book ships. The sample is illustrative; final book pages are regenerated at print resolution and may differ slightly.
9. Refunds and cancellations
Refunds are governed by the Refund Policy, which is incorporated into these Terms. In summary:
- Cancel before printing for a full refund — the cutoff is when our system submits the job to Lulu (order status moves from
paidtosubmitted). - Quality issues (printing defects, damaged in transit, missing pages) — replacement at no charge or full refund, your choice, within 14 days of delivery.
- Partial AI failures — if some pages don't generate cleanly, the policy explains the partial-credit math (80% completion floor).
Refunds are issued to the original payment method via Stripe and typically post in 5 to 10 business days, depending on your bank.
10. Acceptable use
The Acceptable Use Policy (“AUP”) is incorporated into these Terms. The AUP details what you may upload, what you may not, what you may not do with the Service (no scraping, no commercial reselling of generated pages, no model extraction, no infrastructure interference), and the enforcement actions we may take, including immediate termination and law-enforcement reporting for illegal content. To report abuse, email abuse@scribblebook.com.
11. Intellectual property
11.1 Our IP. The Scribblebook brand, the website, our copy, the line-art conversion workflow we built on top of fal.ai, our PDF assembly logic, our cover templates, and the Service as a whole belong to Scribblebook or our licensors. You may not copy, reverse-engineer, scrape, or redistribute any of it except as needed to use the Service normally.
11.2 Your IP. You retain all rights to your uploaded photos. Nothing here transfers ownership of your photos to us.
11.3 Generated pages. The AI-generated line-art pages and assembled book are licensed back to you for personal, non-commercial use — color them, hang them, give the book as a gift. You may not resell, mass-print, or sell merchandise made from the line-art, or use it commercially, without a separate written license from us. AI-generated content has unsettled copyright status under U.S. law; we do not warrant that the line-art output is independently copyrightable.
12. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Scribblebook disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant that the Service will be uninterrupted or error-free, or that any specific photo will produce a satisfying line-art result. AI conversion is probabilistic; some photos render better than others.
13. Limitation of liability
To the maximum extent permitted by law:
- Cap. Scribblebook's total cumulative liability for any claim arising out of the Service or these Terms is limited to the amount you paid for the order in question, or $100 USD if no payment has been made, whichever is greater.
- No indirect damages. Scribblebook is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, data, goodwill, or emotional distress — even if advised of the possibility.
- Carve-out. Some jurisdictions do not allow these exclusions; there our liability is limited to the maximum extent permitted by applicable law. Nothing here limits liability for fraud, gross negligence, or willful misconduct.
14. Indemnification
You will defend, indemnify, and hold harmless Scribblebook, its officers, directors, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of: (a) photos you uploaded without the rights or consents required by Section 4; (b) your violation of these Terms or any law; or (c) your infringement of any third party's IP, privacy, or publicity rights. We will tell you about the claim, let you control the defense with our reasonable cooperation, and not settle without your written consent — provided you do not settle in a way that admits liability for us or imposes any obligation on us beyond paying money.
15. Termination
15.1 By you. You may stop using the Service at any time and request account deletion per the Privacy Policy. Deletion completes within 7 days; financial records required by U.S. tax law are retained for 7 years with personal fields scrubbed on request.
15.2 By us.We may suspend or terminate your access immediately, without notice, for: (a) breach of these Terms, (b) prohibited content under Section 4.5, (c) Service abuse (rate-limit evasion, coupon fraud, payment fraud), or (d) use that creates legal risk for us or other users. For non-fault reasons (sunsetting the product, region pullback), we will give at least 30 days' notice and refund unfulfilled orders.
15.3 Survival.Sections 4.4 (only for the duration of the retention windows), 11, 12–14, 16, and 17 survive termination. Data is deleted on the Privacy Policy schedule.
16. Governing law and dispute resolution
16.1 Governing law. These Terms and any dispute arising out of or related to them are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
16.2 Venue. The exclusive venue for any dispute that is not subject to arbitration is the state and federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
16.3 Informal resolution first. Before filing anything, please email support@scribblebook.com with a description of the dispute and the resolution you'd like. We will try in good faith to resolve it within 30 days.
16.4 Arbitration. If informal resolution fails, you and Scribblebook may agree to resolve the dispute by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in San Francisco, California, with each side bearing its own fees and costs except where the rules require otherwise. Either party may bring qualifying claims in small-claims court instead.
16.5 Class-action waiver. To the maximum extent permitted by law, disputes will be resolved on an individual basis, not as a class, collective, or representative action. Some U.S. states limit the enforceability of class-action waivers; this section is severable to the extent any portion is unenforceable in your jurisdiction.
17. General
Severability. If any provision is held unenforceable, the rest stays in force and the unenforceable provision is reformed to the minimum extent necessary.
Entire agreement. These Terms, the Privacy Policy, the Refund Policy, and the Acceptable Use Policy are the entire agreement between you and Scribblebook regarding the Service and supersede any prior agreements or representations.
No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger or sale of substantially all our assets, on notice to you.
Notices. Legal notices to us go to support@scribblebook.com with subject line beginning “LEGAL NOTICE”. Notices to you go to the email on your most recent order or account.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control — acts of God, carrier strikes, internet or sub-processor outages, war, or government action.
